3. No Transfer of Copyright with an Artwork Purchase
Purchasing an original painting transfers ownership of the physical artwork only.
Unless Sumana Burman signs a separate written copyright assignment or licence, the purchaser does not acquire the right to:
- reproduce the artwork;
- create or sell prints;
- publish or distribute images of it commercially;
- place it on merchandise, packaging or advertising;
- licence the image to another person or organisation;
- create commercial adaptations or derivative works;
- mint or associate it with an NFT or blockchain asset; or
- authorise third parties to reproduce or commercially exploit it.
The purchaser may possess, privately or publicly display, lend and resell the physical artwork, subject to applicable law and any written sale terms.
Ownership of the physical original does not by itself transfer copyright or reproduction rights.
Sumana Burman retains the right to display and reproduce photographs or other representations of sold artworks for portfolios, archives, catalogues, publications, exhibitions, documentation, educational material and promotion, unless otherwise agreed in writing.
4. Permitted Limited Use
Visitors may:
- view the website and its content for personal, non-commercial purposes;
- share a direct link to an official SBFA webpage;
- use an official platform’s built-in sharing function where that function is enabled;
- quote a brief portion of written content where legally permitted, with clear attribution to Sumana Burman Fine Art and a direct link to the original page.
No other permission is implied.
Attribution alone does not grant permission to reproduce, republish, adapt, distribute or commercially exploit any material.
5. Uses Requiring Prior Written Permission
Prior written permission or a written licence is required before any SBFA material may be:
- reproduced in a book, magazine, article, catalogue, publication, exhibition or presentation;
- included in a commercial interior-design proposal or client presentation;
- displayed or republished on another website, social-media account or marketplace;
- used in advertising, marketing, packaging or promotional campaigns;
- printed, projected, broadcast or publicly exhibited as a reproduction or digital presentation, except for the lawful display of a legitimately owned physical original artwork;
- incorporated into merchandise, textiles, stationery or commercial products;
- distributed to students, workshop participants, organisations or commercial audiences;
- translated, adapted, animated or otherwise modified;
- licensed, sublicensed or supplied to another party.
Permission is valid only when granted in writing and may be subject to conditions relating to attribution, duration, territory, medium, circulation, exclusivity, fees and other terms.
6. Prohibited Uses
Unless expressly authorised in writing or otherwise permitted by applicable law, users may not:
- download, copy, scan, reproduce, print, record or republish SBFA content;
- upload or repost artwork images, photographs, infographics or written content as separate content;
- remove or obscure signatures, copyright notices, credits, metadata or watermarks;
- crop, recolour, retouch, distort or otherwise materially alter an artwork image;
- trace, closely copy or reproduce an artwork as another painting, drawing or digital image;
- create derivative commercial artwork substantially based on SBFA’s protected expression;
- present SBFA content as the work of another person;
- falsely claim authorship, ownership, association or endorsement;
- sell, licence or distribute unauthorised reproductions;
- place SBFA material in stock-image libraries, print-on-demand services or digital marketplaces;
- create posters, prints, merchandise, décor products or downloadable files from SBFA material without permission;
- associate protected material with NFTs, tokens, blockchain records or digital collectibles without authorisation;
- use the material for advertising, political promotion, endorsements or commercial campaigns without permission;
- include protected material in commercial databases, archives, collections or image libraries;
- use automated systems to extract, reproduce or aggregate substantial quantities of website content.
The general subject matter, artistic technique, genre, idea, fact, method or style of a work is not claimed as exclusive.
This policy concerns the unauthorised copying, reproduction, adaptation or exploitation of SBFA’s original expression.
7. Artificial Intelligence, Machine Learning and Automated Extraction
No licence is granted to scrape, copy, extract, store, ingest, reproduce or process SBFA content for unauthorised:
- artificial-intelligence or machine-learning training;
- model development;
- model evaluation;
- fine-tuning;
- computer-vision datasets;
- image-generation systems;
- synthetic-media creation;
- embeddings or vector databases;
- prompt libraries;
- style-replication systems;
- automated imitation or reconstruction;
- commercial or research datasets.
SBFA artwork, photographs, writing, infographics, videos and other protected material may not be submitted to an artificial-intelligence system for the purpose of recreating, closely imitating, modifying, training upon or commercially exploiting the protected work without prior written permission.
Nothing in this section is intended to prevent the legitimate operation of services that Sumana Burman Fine Art itself chooses, uses or expressly authorises.
Accordingly, these restrictions do not prevent:
- ordinary search-engine crawling and indexing;
- search-engine optimisation and search-result presentation;
- website security and anti-fraud services;
- content-delivery and caching services;
- analytics and measurement platforms;
- accessibility services;
- translation services authorised by SBFA;
- marketplaces or sales platforms authorised by SBFA;
- merchant feeds and product-discovery services authorised by SBFA;
- artificial-intelligence tools or services deliberately used or authorised by Sumana Burman Fine Art;
- other digital services expressly selected or authorised for SBFA business, creative, administrative, analytical or commercial purposes.
Authorisation for one service or purpose does not create a general licence for unrelated third parties to collect or use SBFA content.
8. Social-Media Sharing
Sharing a direct link to official SBFA content is welcome.
Downloading an artwork image or other protected material and uploading it as a separate post is not the same as sharing a link and requires permission unless the use is otherwise permitted by applicable law.
Where an official platform-sharing function is enabled, the content should remain unaltered and the original account, artist name and source link should remain visible where technically supported.
Reposting content does not transfer copyright or create any ownership interest in the underlying artwork or material.
9. Digital Room Mockups
Digital room mockups are created solely to help viewers understand the potential scale, placement and presentation of an original painting.
The original painting remains hand-painted unless otherwise expressly stated.
The room, furniture, framing, lighting, décor or surrounding environment shown in a mockup may be digitally created, edited, generated or composited.
Such surrounding elements are illustrative and do not form part of the physical artwork being sold unless expressly stated otherwise.
Neither the artwork image nor the complete SBFA mockup may be copied, republished, sold, materially altered or presented as another person’s work without permission.
10. Infographics and Educational Content
SBFA infographics, diagrams, educational resources and visual explanations may not be reproduced in full, converted into templates, republished as social-media slides, incorporated into courses or training material, or distributed to commercial audiences without written permission.
A limited quotation from accompanying written material may be used where legally permitted, provided that the quotation is accurate, proportionate and clearly attributed.
11. Brand Names and identifiers
The names Sumana Burman, Sumana Burman Fine Art, associated logos, original marks and other distinctive brand elements may be protected under applicable copyright, trademark, passing-off and unfair-competition laws.
Nothing on this website grants permission to:
- impersonate Sumana Burman or Sumana Burman Fine Art;
- represent an unauthorised affiliation;
- imply sponsorship, approval, representation or endorsement;
- create a misleading commercial association;
- use SBFA branding in a manner likely to cause confusion regarding origin or ownership.
12. Third-Party Material
Some website functions, fonts, software, plugins, embedded media, platform elements, music, stock assets or other third-party material may remain the property of their respective owners and may be governed by separate licence terms.
This policy applies only to intellectual-property rights owned, licensed or otherwise lawfully controlled by Sumana Burman and Sumana Burman Fine Art.
Nothing in this policy claims ownership of material belonging to a third party.
13. Reporting Suspected Infringement
Suspected unauthorised copying, reproduction, sale, publication, impersonation, misuse or commercial exploitation may be reported to:
Email: contact@sumanabfineart.com
Website: sumanaburmanfineart.com
Please include, where available:
- the location of the original SBFA material;
- the location of the suspected unauthorised material;
- screenshots or other supporting evidence;
- the name of the person, account, organisation or platform involved;
- the date on which the suspected use was observed;
- your contact details.
SBFA may request further information where necessary to assess the matter.
14. Enforcement and Reservation of Rights
Sumana Burman Fine Art reserves the right, where appropriate and permitted by law, to:
- preserve evidence of suspected infringement;
- contact the responsible party;
- contact a hosting provider, marketplace, social-media platform, search engine or other intermediary;
- submit copyright complaints or takedown requests;
- request removal or correction of unauthorised material;
- request attribution where appropriate;
- seek licensing fees or compensation;
- terminate or revoke permissions;
- pursue contractual or statutory remedies;
- seek independent professional or legal advice;
- exercise any other remedy available under applicable law.
A delay or failure to act against one instance of unauthorised use does not waive any rights relating to that use or any later use.
No right, licence, consent or permission is granted except where expressly provided.
15. Lawful Exceptions
Nothing in this policy is intended to restrict an act that is expressly permitted under applicable copyright or other law.
Copyright protects original expression. It does not ordinarily grant exclusive ownership over ideas, facts, methods, general concepts, subjects, genres, techniques or artistic styles themselves.
Applicable law may recognise fair dealing, quotation, criticism, review, reporting, research, education or other statutory exceptions in particular circumstances.
Nothing in this policy is intended to override rights or exceptions that cannot lawfully be excluded by contract or policy.
16. Licensing and Commercial Permissions
Sumana Burman Fine Art may, at its discretion, grant written permission or enter into a licence relating to particular artwork, photography, writing, video, educational material or other protected content.
A licence may specify, among other matters:
- the particular work or material covered;
- permitted uses;
- prohibited uses;
- exclusivity or non-exclusivity;
- territory;
- duration;
- publication or circulation limits;
- medium and format;
- attribution;
- modification rights;
- sublicensing;
- fees or royalties;
- termination conditions.
No commercial licence should be inferred merely because SBFA material is publicly visible online.
17. Sale, Resale and Reproduction Are Separate Rights
The lawful resale of a physical artwork does not by itself authorise the reproduction, commercial publication, merchandising, digitisation or licensing of the artwork image.
Likewise, permission to reproduce an artwork does not transfer ownership of the physical original unless expressly stated in writing.
Physical ownership and intellectual-property rights should therefore be treated as separate rights.
18. Changes to This Policy
This policy may be updated from time to time to reflect:
- new content formats;
- new technologies;
- artificial-intelligence developments;
- marketplace and merchant-feed systems;
- licensing practices;
- business requirements;
- legal or regulatory developments;
- changes to SBFA services or distribution channels.
The latest version published on the website will apply from the date stated at the top of the page.
This policy is intended to explain the copyright and usage conditions applying to Sumana Burman Fine Art content. Specific licensing, infringement or contractual matters may require independent legal advice.
